When Less-Lethal Doesn't Work: The Failure Rates Nobody Advertises

Defensive sprays fail against some people. Probe deployments fail when a probe misses, when clothing stops it, or when spread is inadequate. Contact stun devices fail against anyone willing to absorb pain. None of this is controversial within law enforcement training, where failure is treated as an expected outcome that requires a plan. None of it appears in consumer marketing, where these products are sold as decisive.

Failure is normal, not exceptional
Agencies that deploy these tools at volume publish use-of-force data, and that data consistently shows a meaningful proportion of deployments that do not achieve their intended effect on the first attempt. The figures vary by agency, by device, by year, and by how each agency defines effectiveness, which is precisely why a single headline number would be misleading.
What is consistent across the literature is the shape: these are probabilistic tools, not switches. An officer carrying one is trained to expect it to fail some of the time and to have an immediate next action. A consumer buying one is told it works.
That asymmetry is the problem. The tool is the same. The expectation is not.
Why spray fails
Capsaicin acts on pain receptors and mucous membranes. Anything that reduces the response to pain reduces the effect.
Intoxication, particularly with stimulants, substantially raises pain tolerance. Acute mental health crisis can produce the same result. So can adrenaline in someone who is already committed to what they are doing.
A subset of people appear to be resistant to capsaicin independent of any of that. Repeated exposure also produces some tolerance, which is why people who have been sprayed before are less affected.
Delivery failure is at least as common as physiological failure. Wind carries a cone away. A stream misses. A gel blob lands on a forehead and never reaches the eyes. Format-specific failure modes are covered in pepper gel, spray, foam, and stream.
Onset is not instant. Even a good hit takes seconds to develop, and in those seconds the person can still reach you. This is the most consistently underestimated aspect of spray and the reason distance matters more than potency.
Eyes closing reflexively can reduce contact with the most sensitive tissue, and someone who turns away as you spray may take most of it on the scalp.
Why probe weapons fail
Both probes must penetrate to skin and both must connect. Heavy or loose clothing defeats this routinely, and winter is exactly when someone is wearing the coat that stops a probe.
Spread has to be adequate. Probes landing close together produce localized pain rather than loss of muscle control, which is the difference explained in what a stun gun actually does.
Wires break, probes fall out as the person moves, and a single-cartridge consumer device offers no second attempt.
Aim under stress is the underlying problem behind most of these. A device aimed like a firearm, at a moving target, in poor light, by someone who has never practiced, misses often.
Even a successful deployment produces incapacitation only while current flows. The effect ends when the cycle ends, and the person can get up.
Why contact devices fail
They depend entirely on pain compliance, so every factor that raises pain tolerance defeats them outright.
They require you to be within reach, which means you are already in a grappling situation where the device can be knocked away, turned, or simply endured.
The visible arc is a deterrent to some people and an escalation to others.
What this means for planning
The realistic goal is a window, not a stop. Every one of these tools can produce a few seconds of distraction, pain, or disorientation. What you do with those seconds is the actual plan, and the answer is almost always distance and exit rather than staying to see whether it worked.
Assume it will fail and have a next action. This is what training teaches and what marketing omits. If the spray does nothing, what happens then is a question worth answering before you are in it.
Distance is the resource. Every less-lethal option works better further away, and every one of them fails more catastrophically at contact range. Anything that buys distance, including simply not being there, outperforms the device.
Practice matters more than product selection. An inert training canister costs little and is the only way to find out that aiming a small object at a moving person is hard. Most people buy a canister, put it in a bag, and never deploy one in their life until the moment it matters.
Carrying it accessibly is half of it. A device at the bottom of a bag is not available in the timeframe these situations occupy.
The environment does more work than the device

A less-lethal device addresses the situation that the rest of it failed to prevent. That ordering is the correct one, and a plan that starts with the device has skipped the parts that work more reliably.
What honest product claims look like
A manufacturer stating effective range, capsaicinoid content, expiration date, and cartridge specifications is telling you what you need. One advertising millions of volts, or describing a product as stopping any attacker, is selling certainty that the underlying literature does not support.
The absence of a figure is usually the informative part. Voltage instead of charge. OC percentage instead of capsaicinoid content. Testimonials instead of specifications.
Where any of these devices may lawfully be carried is a separate question with more layers than most people expect, and it is in carrying less-lethal where you actually go.
